The following Terms and Conditions do not affect your statutory rights.

Buying Goods

a) When you place an ‘offer to purchase goods’ (order) by completing and submitting an electronic order for any material or product (in this agreement ‘resources’) by submitting a completed order form on our website, www.dernierpublishing.com, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract with us.

b) Any advice or recommendations given by any representative of Dernier Publishing to the buyer relating to resources, which is not confirmed in writing by Dernier Publishing will not be binding.

c) Any variation to these terms and conditions will be acknowledged on the website.

d) Throughout the website and ordering process and in all correspondence we use the English Language. No other languages are available on this website.

Ordering

a) In submitting an order the buyer acknowledges that:

b) All information and specifications relating to the resources produced by a publisher are approximate and all errors on the website may be corrected without any liability to Dernier Publishing. Covers may vary from those supplied because of monitor and printer capabilities and last minute changes made by publishers.

c) Dernier Publishing may make any changes to the specification of the resources to conform to any statutory  requirements.

d) You will be sent an invitation to review the books you buy, from a trusted independent review body, via email. If you do not wish to receive these emails, you can unsusbscribe quickly and easily.

Right of Withdrawal

Should the buyer wish to withdraw from the contract within 7 working days of submitting the order, please contact Dernier Publishing as soon as possible, and Paypal if you have paid for your goods through the website.

Pricing

a) The price of the resources shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by Dernier Publishing.

b) The price of the resources may not include the cost of delivery to destinations outside of the United Kingdom. For such orders, the Buyer will pay the delivery charge as quoted on the day of purchase.

c) The price of the resources includes any applicable Value Added Tax (VAT), which the buyer shall be liable to pay to Dernier Publishing.

Credit Cards

a) Credit and Debit cards accepted by Paypal are listed on the Paypal’s website.

b) All charges to credit/debit cards will be made at the time of ordering the goods. Any fraudulent use of Credit/Debit cards will be notified to the authorities along with any identification details that were supplied with the order.

c) Any refund made to the Buyer’s credit or Debit card shall be subject to the Terms and Conditions of the Issuing Bank and therefore be subject to any time delay as specified by the Issuing Bank. No liability shall be placed on Dernier Publishing for any delay that is outside of their control.

d) All accepted orders will be processed by Dernier Publishing, PO Box 793, Orpington, BR6 1FA, UK.

Shipping

a) If the buyer does not take delivery of the resources or give Dernier Publishing adequate delivery instructions then no duty of care shall apply, any loss or damage or deterioration to the resources shall not render Dernier Publishing liable.

b) If the buyer does not receive all the goods as specified on the original order then the buyer must notify Dernier Publishing in writing within 14 working days from the date of delivery. If the buyer does not inform Dernier Publishing in writing within the specified time then no liability will be attached to Dernier Publishing. In any event any loss or damage suffered by the buyer as a result of such a delivery shall be limited to the price of the goods not delivered or the cost of replacement resources.

c) Risk of damage or loss of the resources shall pass to the Buyer on delivery or, if the Buyer fails to take delivery of the Goods, the time when the Supplier has tried to deliver the Goods.

d) Title shall pass to the buyer on delivery of the goods.

Warranty and Ownership

a) Subject to the conditions set out below Dernier Publishing warrants that the resources will correspond with the order at the time of delivery and will be free from defects on delivery. If Dernier Publishing is in breach of this warranty the buyer shall notify Dernier Publishing within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty Dernier Publishing may, at its sole option either replace all the faulty resources or refund the price of the resources that are defective. This shall be the extent of the liability of Dernier Publishing and no consequential loss claim of any kind shall be made against Dernier Publishing.

b) If you are returning an item because of an error on our part, we will be happy to refund the delivery charges incurred in sending the item to you and your costs in returning it to us. Where you are withdrawing from your purchase within the seven working days cooling-off period, we will also refund the normal postage charge for the delivery of that item but we cannot refund any priority, express or courier component of the postage charge. You will be responsible for those charges.

Your Statutory Rights

a) At Dernier Publishing we want you to be happy every time you shop with us. Occasionally though, we know you may want to return items. That’s why under our “no quibbles” guarantee if, for any reason you are unhappy with your purchase, you can return it to us in its original condition within 14 days of the date you received the item.

b) By law, you also have the right to withdraw from your purchase of an item within seven working days of the day after the date the item is delivered to you. This applies to all of our products except for where the item has been downloaded.

c)To cancel your purchase under this cooling-off period, please put a note in with your product explaining the reason for the return as “contract cancellation”. Please package the relevant item securely and send it to us with the delivery slip so that we receive it within seven working days of the day after the date that the item was delivered to you. d) For your protection, we recommend that you use a recorded-delivery service.

e) Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error. Shipping Overseas

a) Dernier Publishing will not be responsible for complying with any legislation or regulation governing the importation of resources into the country of destination.

Withdrawal of Goods

a) Dernier Publishing may withdraw the sale or distribution of any resources produced by or generally supplied by Dernier Publishing without prior notice, or liability, to the Buyer.

What We Do With Your Information

The confidentiality of your personal information is of paramount concern to Dernier Publishing. We do not share any of your information with any third party, unless necessary for the fulfilment of goods or services you have requested.

When you buy goods or services from us, we collect information such as your name, address, and email address, so we can send your products.

To protect your security, we use the latest secure socket layer technology (SSL) on our websites.

Retaining Your Data

We keep data only for essential reasons; for processing your order, and for purposes of legal accounts.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).
